These Terms and Conditions (the “Terms”) govern your use of goldrushbrush.com (the “Site”) and any purchase you make from Gold Rush Brush, a brand operated by I Am Danie LLC (“Gold Rush Brush,” “we,” “us,” or “our”). By visiting the Site, creating an account, or placing an order, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use the Site or purchase our products.

1. Eligibility and Lawful Use

You must be at least the age of majority in your state or place of residence, or have permission from a parent or legal guardian, to use the Site or make a purchase. You agree to use the Site only for lawful purposes and to provide accurate, current, and complete information.

2. Online Store Platform

Our online store is hosted by Shopify. Shopify provides the e-commerce platform that allows us to offer and sell our products. Your use of Shopify-powered features may also be subject to Shopify’s applicable terms and policies.

3. Product Information and Intended Use

We make reasonable efforts to display product descriptions, colors, finishes, dimensions, and photographs accurately. Screen settings, lighting, production variations, and photography may cause the product you receive to appear slightly different from what is shown online.

The Gold Rush Brush is sold as a hair-wrapping tool for silk presses, sew-ins, and extensions. Individual results vary based on hair, installation, technique, products used, and nightly routine. We do not guarantee a particular styling result or the duration of any hairstyle.

Some brushes from our original inventory may display the Danified name. This original branding does not affect the product’s intended function and is not considered a defect. Any applicable original-batch disclosure shown on the product page forms part of the product description.

4. Prices, Taxes, and Payment

Prices are shown in U.S. dollars and may change without notice. The price displayed when your order is submitted will apply to that order, subject to correction of clear pricing or listing errors.

We accept the payment methods displayed at checkout, which may include major credit or debit cards, Shop Pay, Klarna, and Afterpay where available. Installment services are provided by third parties and are subject to their own eligibility requirements and terms.

Applicable taxes will be calculated at checkout. Standard U.S. shipping is currently included in the product price when the Site displays free shipping. Any optional or additional charges will be shown before you complete checkout.

5. Orders, Acceptance, and Cancellation

Your order is an offer to purchase. We may accept, reject, limit, or cancel an order for reasons including suspected fraud, unauthorized activity, inventory errors, pricing errors, payment issues, or violation of these Terms. An automated order confirmation does not necessarily mean that we have accepted the order.

Contact us promptly if you need to request a cancellation or address change. We cannot guarantee changes or cancellations after an order enters processing or ships. If we cancel an order after payment, we will refund the amount charged for the canceled item or order.

6. Shipping and Delivery

We currently ship within the United States only. In-stock orders are generally processed within 1–2 business days, excluding weekends and holidays. Delivery time begins after the carrier receives the package and is an estimate, not a guarantee. We currently do not offer expedited shipping.

You are responsible for providing a complete and accurate shipping address. Please contact us immediately if you notice an error. Once an order has shipped, we may be unable to change its destination.

Carrier delays, severe weather, holidays, incorrect addresses, and other events outside our reasonable control may affect delivery. If we cannot ship within the promised time, we will provide any cancellation or refund rights required by applicable law.

Tracking marked “delivered” is based on carrier information. If you cannot locate a delivered package, check the delivery area and contact the carrier, then email us so we can review the available information. We do not guarantee replacement of packages confirmed as delivered, except where required by law or where our review shows that we are responsible.

7. Final Sale and Order-Issue Policy

Because the Gold Rush Brush is a personal-care item, all sales are final. We do not accept general returns or exchanges for change of mind, preference, or items that have been used, except where required by applicable law.

If your item arrives damaged or defective, or if you receive the wrong item or an incomplete order, contact dwilksconsulting@gmail.com within 7 days of delivery. Include:

  • Your order number

  • A clear description of the issue

  • Clear photos or video of the item, packaging, and shipping label

Please do not use the item while your request is being reviewed. Approved claims may be resolved through a replacement, correction, store credit, or refund, as appropriate and as required by law. Normal cosmetic variation, ordinary wear, damage caused after delivery, improper use or storage, and the disclosed Danified branding on original-batch inventory are not defects.

Nothing in this section limits rights that cannot legally be waived.

8. Product Use and Care

Use the product carefully and only as intended. Stop using it if it becomes damaged or causes discomfort. Keep it clean and store it in a dry location. You are responsible for determining whether the product is appropriate for your hair, extensions, installation, and styling routine. When in doubt, consult your hairstylist or extension professional.

9. Intellectual Property

The Site and its content—including the Gold Rush Brush name, logos, product names, photographs, videos, graphics, designs, text, and website layout—are owned by or licensed to I Am Danie LLC and are protected by applicable intellectual-property laws.

You may access the Site for personal, noncommercial shopping purposes. You may not copy, reproduce, modify, distribute, sell, publish, scrape, or commercially exploit Site content without our prior written permission.

10. Reviews, Photos, and Other Submissions

If you submit a review, comment, photo, video, testimonial, or other content, you confirm that it is truthful, that you have the right to share it, and that it does not violate another person’s rights or applicable law.

You grant I Am Danie LLC a nonexclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and share that content for operating and promoting Gold Rush Brush, subject to applicable law. You retain ownership of your original content. We may remove submissions that are unlawful, misleading, abusive, infringing, or otherwise inappropriate.

11. Third-Party Services and Links

The Site may contain third-party tools, payment services, apps, or links. We do not control and are not responsible for third-party websites, products, services, privacy practices, or terms. Review the third party’s terms before using its service or completing a transaction.

12. Prohibited Conduct

You may not:

  • Use the Site or products for an unlawful or fraudulent purpose

  • Interfere with the Site’s security, operation, or availability

  • Introduce viruses, malicious code, or automated scraping tools

  • Attempt unauthorized access to accounts, systems, or data

  • Submit false, misleading, infringing, abusive, or harmful content

  • Use our intellectual property without authorization

  • Circumvent purchase limits or misuse promotions

We may suspend or terminate access for conduct that violates these Terms.

13. Privacy

Our collection and use of personal information are described in our Privacy Policy. By using the Site, you acknowledge that information may be processed by Shopify and other service providers necessary to operate the store, process payments, prevent fraud, fulfill orders, provide customer support, and—when you opt in—send marketing communications.

14. SMS Marketing

If you provide your mobile phone number and affirmatively opt in to SMS marketing, you agree to receive recurring automated promotional and personalized text messages from Gold Rush Brush at the mobile number you provided. These messages may include product updates, offers, reminders, and other marketing communications.

Consent to receive marketing text messages is not a condition of purchase. Message frequency varies. Message and data rates may apply.

You can opt out at any time by replying STOP to a message. For help, reply HELP or contact us at support@goldrushbrush.com. Your mobile carrier is not liable for delayed or undelivered messages. We may use Shopify and other service providers to send and manage SMS marketing on our behalf, as described in our Privacy Policy.

15. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and products are provided “as is” and “as available.” We do not promise that the Site will always be uninterrupted, secure, or error-free, or that a product will produce a specific styling result.

We disclaim implied warranties to the extent they may lawfully be disclaimed. Some states do not allow certain warranty exclusions, so parts of this section may not apply to you.

16. Limitation of Liability

To the fullest extent permitted by law, I Am Danie LLC and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, punitive, or consequential losses arising from your use of the Site or products.

To the fullest extent permitted by law, our total liability for a claim relating to an order will not exceed the amount you paid for the product giving rise to that claim. These limitations do not apply where liability cannot legally be limited or excluded.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless I Am Danie LLC and its owners, employees, contractors, affiliates, and service providers from third-party claims, damages, or reasonable expenses arising from your unlawful use of the Site, your violation of these Terms, or your infringement of another person’s rights.

18. Severability and No Waiver

If any provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.

19. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted on this page with a new effective date. Changes apply prospectively unless applicable law requires otherwise. Your continued use of the Site after an update means you accept the revised Terms.

20. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where the consumer-protection laws of your place of residence require otherwise.
